Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.151/2021 registered in Police Station Kurud, District Dhamtari for offence under Section 294, 323, 506, 326, 34 of the IPC.
2. On dispute concerning flowing of drain water, two neighbouring families picked up a quarrel in which the applicant along with 3 other co-accused have assaulted injured, Laxmi, Govind, Gulechi Sahu and Udai Krishna Sahu by means of axe and hands & fists. Although Govind has suffered incised wound on left temporal parietal region, but
MCRC No. 4625 of 2021 the injury was not accompanied with fracture. On a report lodged by the present applicant party, counter case has also been registered against the injured persons.
3. Considering that all the offences are triable by the JMFC, the applicant is in jail since 7.6.2021 and charge sheet has already been filed, I am inclined to release the applicant on bail.
4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
