This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and no other bail application is pending before any other Court.
2. The applicants have been arrested in connection with crime No. 215/2019 registered at Police Station - Dongargarh District Rajnandgaon (C.G.) for the offence punishable under Section 34(2) of the C.G. Excise Act.
3. Case of the prosecution, in brief is that on 24.04.2019, 10.440 bulk liters foreign liquor has been seized from the applicants.
4. Govt. Advocate submits that no criminal antecedent of the applicant No.1 Gaurav Gouli is reported in the police case diary however against applicant No. 2 Akash Yadav @ Aman three criminal cases have been registered, out of which two are under IPC and one is under Arms Act, against applicant No.3 Arun Gouli two cases have been registered out of which one is under IPC and another is under Excise Act.
5. Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if applicant No.1 Gaurav Gouli furnishes one solvent surety for a sum of Rs.25,000/- along with a personal bond of Rs. 25,000/- to the satisfaction of the concerned Trial Court, he be released on bail.
6. Looking to the above facts and circumstances of the case, It is directed that if the applicant No.2 Akash Yadav furnishes two solvent sureties for a sum of Rs.25,000/- each along with a personal bond of Rs. 50,000/- to the satisfaction of the concerned Trial Court, he be released on bail.
7. Looking to the above facts and circumstances of the case, It is directed that if the applicant No.3 Arun Gouli furnishes two solvent sureties for a sum of Rs.25,000/- each along with a personal bond of Rs. 50,000/- to the satisfaction of the concerned Trial Court, he be released on bail.
