(2) After arguing at length, learned counsel appearing for the petitioner would submit that the impugned order dated 17.12.2015 passed by respondent-Secretary, Department of School Education, Raipur is appealable before the appellate authority and, therefore, he may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed within a period of two weeks from today and, in turn, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of two months from the date of receipt of appeal of the petitioner.

(5) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
