1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.279/2013, registered at Police Station Moudhapara, Raipur, Distt. Raipur for the offence punishable under Sections 420, 467, 468 and 471 read with Section 34 of the IPC.

2. Case of the prosecution, in brief, is that the applicant along with co-accused obtained Rs.10 lakhs to secure employment for the complainants and thereby committed the offence.

3. Learned counsel for the applicant would submit that the applicant has not committed any offence and he has been falsely implicated in the case. Co-accused Umakant Shandilya has already been released on bail by the Court below and therefore, the present applicant may also be released on bail. The applicant is in jail

since 29-5-2014. He has already suffered suspension from employment.

4. On the other hand, learned State counsel would oppose the bail application.

5. I have heard learned counsel for the parties and gone through the case diary.

6. Taking into consideration the facts and circumstances of the case, nature and gravity of the offence, the manner in which Rs.10 lakhs have been obtained by the applicant and other co-accused, I do not find any case for grant of bail to the applicant. The bail application is, therefore, rejected.
