This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.193/2015, registered at Police Station-Arang, District-Raipur (CG), for the offence punishable under Sections 363, 366, 376 & 493 of the IPC and Sections 5 & 6 of the Protection of Children from Sexual Offences Act. 2.
I have heard learned counsel for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence, the fact that the prosecutrix is said to be minor on the date of commission of offence and the manner in which the applicant is said to have been kidnapped the minor prosecutrix and committed sexual intercourse with her, I do not find any ground for grant of bail to the applicant.
