After arguing for some time learned counsel for the petitioner seeks to withdraw this petition with liberty to raise appropriate objection before the Revenue Court in mutation proceedings.

No such liberty is necessary. If the petitioner's case is that, revenue proceedings are not maintainable, it is always open for the petitioner to move an application for the culmination of the revenue proceedings before the concerned Revenue Court where

application has been filed.
