1. Heard.

2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.173/2021, registered at Police Station Vidhansabha, District - Raipur C.G. for the offence punishable under Sections 457, 380, 34 of the I.P.C.

3. Applicant along with two juvenile has committed theft of 10 ceiling fans, 5 tables, chairs, iron grill and utensils available in the Government Primary School, Saddu.

4. Learned State counsel would oppose the prayer for grant of bail, however, he would submit that applicant has previous antecedent of his involvement in committing one more case.

5. Considering the entire fact situation of the case and for the fact that offence is triable by JMFC and the applicant is in jail since 08.6.2021 i.e., for three months and the charge-sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on the following conditions: • he shall execute a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.

• He shall appear before the trial Court on each and every date given by the said Court.

• The applicant shall not get himself involved in committing any other offence during the pendency of the present trial and shall also appear before the concerned Police Station between 11 am and 2 pm on first day of every month.

• In case these conditions are violated, this bail order granting bail to the applicant shall automatically stands canceled and in that event the concerned Investigating Officer would be entitled to take the applicant into custody.
