Learned counsel for the petitioner submits that during the pendency of the petition, the seized essential commodity has been released in favour of the petitioner upon depositing the penalty amount. However, he submits that the petitioner intends to challenge the same before appropriate Forum provided under the law. 2.
In view of this statement made by learned counsel for the petitioner and considering the submission of learned counsel for the State that the petitioner has an alternative remedy of preferring appeal/ petition against the Appellate Authority constituted under the provision of the Essential
Commodities Act and the Rule/Orders made thereunder, this petition is dismissed with liberty to the petitioner to challenge the order before appropriate Authority.
