Agrawal Order On Board /07/201 (1) Counsel for the petitioner submits that respondent No. 5- Chief Municipal Officer, Nagar Panchayat, Bhakhara has initiated process for demolition of his house and shop without being given any notice to him.

(2) Per contra, learned counsel for the State would submit that at present no action for demolition of petitioner's house / shop is

being taken and whenever the action will be taken, opportunity of hearing will be given to the petitioner.

(3) I have heard learned counsel appearing for the parties and perused the order impugned with utmost circumspection. (4) Be that as it may, it is directed that if the action is proposed against the petitioner to demolish his house, competent authority will issue notice to the petitioner and after giving due opportunity of hearing to the petitioner, pass an appropriate order in accordance with law.

(5) With the aforesaid observations, the writ petition stands finally disposed of.
