At the outset learned counsel for the applicant submits that he may be permitted to withdraw the instant CRMP with liberty to raise the issue before appropriate authority for confiscation procedure i.e. Collector, Raigarh. 2.

As prayed, instant CRMP is dismissed as withdrawn reserving aforesaid liberty to the applicant.

Needless to mention that the applicant may raise issue for the relief before the Collector, Raigarh authorized to proceed with the confiscation proceeding. The competent authority authorized for confiscation in case any prayer is made shall dispose of the same without being influenced by any of the order of the trial Court dated 2-2-2016 and that of revision court dated 9-2-2016.

4. Petition is disposed of accordingly.
