1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 05.06.2020 in connection with Crime No. 284/2020 registered in Police Station- Chhaoni, District Durg (CG) for the offence punishable under Section 394 read with Section 397/34 of IPC and Section 25 (1-B) of Arms Act.

2. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
