1. The grievance of the petitioner is that husband of the petitioner namely Gyaneshwar Motdhare, who was working as Ranger in the Forest Department was removed from services after conviction was recorded by the Judicial Magistrate First Class, Ambagarh Chowki, District Rajnandgaon vide order dated 9-3-
2017. The termination was effected on 7-4-2017 (Annexure P/3) and consequently dismissal order was passed. Criminal appeal was filed against conviction of Judicial Magistrate First Class which was partly allowed by Second Additional District Judge, Rajnandgon. Thereafter, the petitioner has filed the departmental appeal before the Chief Conservator of Forest as per Chhattisgarh Civil Services (Classification, Control and Appeal) Rules 1966 on 19-7-2019.
2. Learned counsel for the petitioner would submit that since the departmental appeal is pending before the respondent No.2, a direction may be passed to decide the said appeal.
3. Considering the limited prayer made by the petitioner that since the departmental appeal against the termination has already been preferred before the respondent No.2, it is directed that the respondent No.2 shall consider and decide the said appeal within a period of 90 days from the date of receipt of a copy of this order.
4. With the aforesaid observation/direction, the writ petition stands disposed of.
