Learned counsel for the State would submit that order passed by the Chief Executive Officer, Kartala is appealable before the Collector, Korba.

Learned counsel for the petitioner would submit that he may be permitted to file an appeal/representation before the Collector Korba.

Prayer appears to be fair and reasonable.

If the petitioner files an appeal/representation before the Collector, Korba within a period of 15 days from today, the Collector Korba would do well to decide the same as early as possible preferably within a period of two months from the date of filing of the appeal/representation.

With the aforesaid observation, writ petition stands finally disposed of. No order as to cost(s).

It is made clear that this Court has not expressed any opinion on the merits of the case and the appellate authority may decide the appeal/representation on its own merit.
