This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.195/2015, registered at Police Station-Aamanaka, District-Raipur (CG), for the offence punishable under Section 394 of the IPC.

Case of the prosecution, in brief, is that on 20.9.2015 the applicant and co-accused persons robbed copper coated wire worth `10,000/- from AIMS Hospital, Raipur.

Learned counsel for the applicant would submit that the applicant has not committed any offence and he has falsely been implicated in crime in question. He would further submit that improbable story has been concocted to implicate the present applicant, in which he is in jail since

21.9.2015 and charge-sheet has been filed. Therefore, he may be released on bail.

On the other hand, learned State counsel would oppose the bail application.

I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the nature and gravity of the offence, facts and circumstances of the case and the manner in which the applicant robbed copper coated wire from hospital premises and on being caught, assaulted complainant Santosh Kumar Singh, I do not find any ground for grant of regular bail to the applicant. Consequently, bail application is rejected.
