Agrawal Order On Board 09/03/2016 (1) This is fourth bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.90/2014, registered at Police Station Koni, Bilaspur, for the offence punishable under Sections 420, 467, 468, 471, 472/34 of the Indian Penal Code. (2) The first, second & third bail applications of the applicant were dismissed on merit by orders of this Court dated 20.11.14, 02.11.15, 12.2.16 passed in M.Cr.C.No.5906/2014, M.Cr.C.No.6134/2015, M.Cr.C.No.1112/16 .

(3) Learned counsel for the applicant submits that there is delay in trial and the applicant is in jail since 14.06.2014 and co-accused namely Narad Tiwari @ Narendra Tiwari has already been released on bail on 13.10.2015 passed in M.Cr.C. No.5276/2015 and therefore, he

may be released on bail on the ground of parity and delay in trial. (4) After hearing learned counsel for the parties, taking into consideration the facts and circumstances of the case, nature and gravity of the offence, I do not consider it is a fit case to entertain fourth bail application. Consequently, fourth bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same expeditiously.
