Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.95/2021 registered in Police Station Civil Lines, Raipur, District Raipur for offence under Section 376 & 506 of the IPC.
2. The applicant is the cousin of the prosecutrix, aged about 25 years. Their houses are adjoining and on the date of the incident, the prosecutrix had gone to the applicant's house for taking bath. At this point of time, the applicant committed forcible sexual intercourse which was seen by the mother of the prosecutrix.
3. Her statement is read over by the learned State Counsel. It is not her
MCRC No. 4593 of 2021 case that her mother arrived after she raised alarm. It is co-incidence that her mother reached while the sexual act was being performed by the applicant.
4. Considering the entire fact situation of the case and for the fact that the applicant is in jail since 26.2.2021 and charge sheet has already been filed, I am inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
