(2) Dispute regarding the succession is pending consideration before the jurisdictional Civil Court and it appears that interim order is operating regarding pension benefits and in the meanwhile, instant writ petition has been filed by the petitioner for claiming that the retiral dues has not been paid to him.

(3) Since, the petitioner's representation is pending consideration

before the jurisdictional Civil Court, it is directed to the Third Civil Judge, Class-I, Durg to do well and take a decision on the Civil Case No. 137/2012 (Amrit Bai Vs. Block Education Officer & Ors.), which is pending between the parties and conclude it preferably within a period of three months from the date of receipt of certified copy of this order. (4) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
