Versus
State Of Chhattisgarh Through Police Of Police Station Saja, Tahsil & District Bemetara, Chhattisgarh, Civil & Revenue District Bemetara Chhattisgarh.
---- Respondent ________________________________________________________ For applicant - Shri Ratnesh Kumar Agrawal, Advocate. For Respondent/State -Shri Sangarsh Pandey, Dy.G.A. Hon'ble Shri Justice Goutam Bhaduri Order 15/03/2016 1.
This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 33/14 registered at Police Station Saja, District Bemetara (C.G.) for offence punishable under Sections 420, 467, 468, 471 & 34 of Indian Penal Code. 2.
As per the prosecution case it is allegation that the applicant obtained money from different candidates and thereafter substituted their teachers eligibility test certificate marksheet with a higher number as in certificate of one Dhanvantin instead of 42 marks it was made to 76marks, in certificate of Raju Ram from 65 marks it was made 87 marks. Likewise for the other candidates numbers were enhanced and on that basis different candidates obtained the job whereby eligible candidates were deprived. 3.
Learned counsel for the applicant submits that applicant himself is working as a teacher from 1989 and FIR was made in 2014 and all of a sudden without any reason applicant has been named and he has been falsely implicated in this case, therefore the applicant may be granted benefit of anticipatory bail.
4.
Learned State counsel opposes the prayer for grant of bail. 5.
I have perused the statement of Ramchandra and Dhanvantin. In the statement of Ramchandra direct allegation have been attributed against this applicant that he has obtained money and thereafter managed to provide him result sheet with enhanced number. Taking into such allegation, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
Accordingly, the anticipatory bail application is dismissed. Sd/- (Goutam Bhaduri) JUDGE gouri
