1. The counsel for the petitioner makes a submission that as of now the petitioner do not intend to challenge the impugned orders Annexure P/1 to P/3 dated 24.04.2019, 07.02.2019, 30.01.2019 & 21.01.2019 so far as it relates to the rejection of his rate contract, forfeiture of the EMD and blacklisting of the petitioner.

The counsel for the petitioner confines his claim to the extent of the payments, which were due to the petitioner in respect of the supply of Vermi Compost supplied by the petitioner to the respondent No.1. According to the petitioner, the supply has been completed and the satisfaction certificate also has been released by the authorities concerned. He further submits that the payment in this regard has

also been received by the respondent No.1 from the State Government. He makes a prayer that the respondent authorities may consider release of the said payment in accordance with agreement entered into between the parties.

3. To the limited prayer, the counsel for the respondent No.1 do not oppose.

4. Accordingly, the writ petition stands disposed of with a direction to the respondent No.1 to consider the claim of the petitioner so far as releasing of the payment due to the petitioner so far as the supply of the Vermi Compost supplied by the petitioner to the respondent No.1. It is expected that the authorities concerned would take a decision at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order.

5. So far as challenge to the impugned orders Annexure P/1 to P/3 are concerned, the liberty is reserved for the petitioner to approach the concerned authority by way of making a suitable representation.

6. With the aforesaid observations, the present writ petition stands disposed of.
