(1) Order impugned passed by the Labour Court under the provisions of C.G. Industrial Relation Act, 1960 (for short "Act,1960") is appealable before the Industrial Court under Section 65 of the Act, 1960, therefore, this Court is of the
considered opinion that since the effective alternative remedy is available to the petitioner, the present petition as framed and filed is not maintainable.
(2) Accordingly, the writ petition is dismissed as not maintainable. However, the petitioner is at liberty to file appeal before the appellate Authority in accordance with law. (3) The certified copy of the order impugned be returned to the counsel for the petitioner, after furnishing an attested photocopy thereof.
