Justice Rajani Dubey Order On Board 17/08/2020 The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody in connection with Crime No. 42/2020 registered at police station Jhagrakhand, district Koriya (CG) for the offence punishable under Sections 294,506,307,34 IPC.
As per prosecution case, the applicant and the co-accused persons with a common intention to commit murder of the victim called him to his house and assaulted him and caused injuries. Counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that there was some land dispute between the victim and the applicant and therefore a false case has been lodged against him. Lastly, he submits that the applicant is in jail since 02.05.2020; charge sheet has been filed and
looking to the conduct of the prosecution it is clear that the trial will take time for its conclusion, therefore he may be released on bail. On the other hand counsel for the State opposes the bail application and submits that the victim has suffered grievous injury on the head.
Having heard counsel for the parties, considered the totality of the fact, in particular the detention period of the applicant, I am inclined to release him on regular bail. Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is allowed. It is directed that in the event of the applicant's furnishing a personal bond in the sum of Rs. 25,000/- with one surety for the like sum to the satisfaction of the concerned Court, he shall be released on bail.

Hon'ble Smt. Justice Rajani Dubey Order on Board 01/09/2020 This is ofÏce reference seeking modification in the order passed in M.Cr.C. No. 4620/2020 with regard to date. In M.Cr.C. No. 4620/2020, the order dated was "28.08.2020" but due to typographical error, it has been wrongly mentioned as "17.08.2020".
The error is apparent on the face of the record which needs to be rectified.
Accordingly, it is ordered that in the M.Cr.C. No. 4620/2020 the date of order be read as "28.08.2020" instead of 17.08.2020.
Copy of this order be supplied to the counsel for the petitioner along with the copy of order dated 17.08.2020
passed in MCRC No. 4620/2020.
