Learned State counsel submits that in the present case, the applicant involved in connection with offence under Section 450, 376 (2)(h) of IPC as well as for alleged commission of offence under Section 3(2)(V) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and application having been rejected by the Court below appealable one under Section 14-A of the SC and ST Act. 2.

Considering the submission and that in large number of cases, applications have been withdrawn with liberty to file appeal.

This application is therefore dismissed. However, the applicant would be at liberty to file appeal under Section 14-A of the SC and ST Act. 4.
