(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 239/2015 registered at Police Station Nawagarh, District Bemetara for the offence punishable under Sections 294, 506(B), 323 & 326/34 of Indian Penal Code and Section 4 & 5 of Chhattisgarh Tonhi Pratadna Nivaran Adhiniyam. (2) Taking into consideration the facts & circumstances of the case; nature and gravity of the offence and the manner in which applicant caused injuries to complainant - Kaushalya by which
she has lost her vision in right eye completely, which is apparent from the opinion of the Medical Officer, at this stage; I am not inclined to release the applicant on bail. Thus, the bail application is rejected.
