This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.33/2015, registered at Police Station-Bilha, District-Bilaspur (CG), for the offence punishable under Sections 363, 366-A, 376 of the IPC and Section 4 of the POSCO Act.

Learned counsel for the applicant would submit that bail was granted to the applicant on 23.4.2015, but he could not appear before the trial Court on 7.9.2015, therefore, he has been arrested. 3.
Taking into consideration the facts & circumstances of the case, nature & gravity of the offence and reasons for absence on 7.9.2015, this Court is of the opinion that present is a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed by the trial Court. Sd/- (Sanjay K. Agrawal) JUDGE B/-
