At the outset, learned counsel for the petitioner submits that he be permitted to withdraw the instant Cr.M.P. with liberty to approach before the Collector, North Bastar, Kanker to take part in the confiscation proceeding and to raise the issue in the said proceeding.

On due consideration, the instant Cr.M.P. is permitted to be withdrawn reserving the aforesaid liberty.

The petition dismissed as withdrawn with the aforesaid liberty. 7.
Needless to mention that as per settled law, the Collector is not required to be influenced by any of the appreciation passed by the Court below also by the revisional Court. The Collector has to decide the matter on the basis of its own merit and relevant confiscation laws.
