This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants, who have been arrested in connection with Crime No.158/2015, registered at Police Station-Chhura, Distt. Gariyaband (CG), for the offence punishable under Section 20 (B) of the NDPS Act.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; quantity of contraband article ganja i.e. 10 kg. seized from the applicants and provisions contained in Section 37 (1) (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, this Court is not inclined to release the applicants on regular bail. 3.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible as two witnesses have already been examined Sd/- (Sanjay K. Agrawal) JUDGE B/-
