1. By the impugned order, opportunity to lead evidence has been closed by the trial Court.

2. I have heard learned counsel for the parties and perused the impugned order.

3. Considering the submission made by learned counsel for the parties and reason assigned in the application and in the interest of justice, the impugned order is set aside, subject to payment of cost of Rs.2500/- payable to the defendants on the next date of hearing and on that day, Brijlal and Buddhuram will be produced before the trial Court for re-examination. The parties are directed to appear before the trial Court on 29 th October, 2018 and cost

will be paid to the defendants on that day.

4. The writ petition is allowed to the extent indicated hereinabove. The trial Court is directed to conclude the trial as early as possible preferably within as period of six months from the date of receipt of certified copy of this order. No cost(s). Copy of order be sent to trial court.
