(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing her on regular bail during trial in connection with Crime No. 733/2015 registered at Police Station Ambikapur, District Surguja (C.G.) for the offence punishable under Section 22B of the NDPS Act. (2) Having heard learned counsel appearing for the parties and taking into consideration the nature & gravity of the offence; facts & circumstances of the case and the recovery of 12.960 grams of brown sugar from the possession of the applicant, which is more than the small quantity in view of the provisions contained in Narcotic Drugs and Psychotropic Substance Act, I am not inclined to release the applicant on bail.
