Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 17.3.2017 Heard on IA No.01/17 for condonation of delay in filing the MCC as the same has been preferred after 07 days of its limitation.

The respondent was not noticed in MA No.01/2017. 3.

On due consideration, issuance of notice to the respondent in the instant MCC is not required.

Heard counsel for the applicant on IA No.01/17. 5.

On due consideration IA No.01/17 is allowed and the delay in filing the instant MCC is hereby condoned. 6.

Also heard the matter finally.

Learned counsel for the applicant would submits that the Registry has pointed out two defaults, out of which one default was cured and the applicant undertakes to remove the remaining default within seven days from today. Hence, MA No.01/17, dismissed on a peremptory order dated 05.01.2017, may be restored to its original number.

On due consideration, the instant MCC is hereby allowed. 9.

The applicant is directed to remove the default pointed out by the Registry in MA No.01/17 within a week from today. With this precondition, MA No.01/17 is restored.

If the applicant/appellant fails to remove the default within a week from today, then this order shall lose its efficacy regarding restoration of said Misc. Appeal.

MCC disposed of.
