1. Learned counsel appearing for the petitioner would submit that ₹ 11,25,136/-, which is due for payment to the petitioner, has been withheld by the Executive Engineer, Water Resources Department by order dated 14.9.2015 (Annexure P/5) without assigning any reason relying upon the judgment of this Court in the matter of M/s. Shree Construction Vs. State of Chhattisgarh & Ors. 1

2. Learned State Counsel would submit that the aforesaid amount has been withheld on account of some amount is due to be paid by the petitioner in some other contract and recovery is to be made from the 1 AIR 2012 Chhattisgarh 139

petitioner.

3. Be that as it may, the petitioner is at liberty to make representation before the respondent-authorities along with decision rendered by this Court in M/s. Shree Construction (supra) within two weeks from today, if representation is rejected and in turn, the respondent-authorities would take a decision within further two weeks from the date of receipt of representation and for the period of four weeks, no coercive steps shall be taken by the respondents against the petitioner.

4. With the aforesaid observation, the writ petition finally stands disposed off. No order as to cost(s).
