Though, the challenge is to the order passed in appeal against the order of dismissal from service in departmental enquiry, learned counsel for the respondent raises an objection with regard to the maintainabililty that the petitioner has a remedy of approaching the Central Government Industrial Tribunal (CGIT) at Jabalpur. On the face of said objection, learned counsel for the petitioner seeks to withdraw this petition

with liberty to approach the Tribunal.
