HIGH COURT OF CHHATTISGARH, BILASPUR Order Sheet REVP No.59 of 2016 Naimuddin Siddiqui & another Versus State of Chhattisgarh & Ors. 27/07/2016 Shri Jitendra Pali, Advocate for the petitioners. Shri Vivek Sharma, Advocate for the State/respondent No.1.

Petitioners herein filed writ petition No.5586/2009 before this Court assailing their termination order dated 29.08.2009 on the post of Shiksha Karmi Grade-III. Vide order dated 12.02.2013, the writ petition was allowed and order impugned dated 28.08.2009 terminating the services of the petitioner was set aside. Aggrieved with that order the State government and the local body preferred Writ Appeals and after due consideration the same was allowed vide order dated 01.09.2014. While allowing the writ appeal this Court has placed reliance on the previous judgment passed in Writ Appeal No.308/2013 (Manoj Gupta Versus State of Chhattisgarh & others). The order passed in writ appeal was unsuccessfully challenged by the petitioner before the Supreme Court, however, the said SLP was dismissed on 01.12.2014 vide Annexure No.A/3.

By this application the petitioner has sought for the review of the order dated 01.09.2014 passed in writ appeal. The order passed by this Court has already been affirmed by the Apex Court in the SLP. No such ground has been raised in the present petition which can be entertained by this Court.

The review petition being without substance is dismissed accordingly at the motion stage itself. Even, otherwise also the review petition is hopelessly barred by limitation and on this ground also the same is liable to be dismissed.
