Apprehending arrest in connection with Crime No.47/1984 registered at Police Station- Chakradharnagar, District Raigarh (C.G.) for the offence punishable under Section 294, 506, 323, 341 of the Indian Penal Code, the applicant has preferred this application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail.

The application has been filed for cancellation of arrest warrant, which is issued by the Judicial Magistrate First Class, Raigarh. The offence as appears under Section 294 & 506 are bailable in nature, therefore, the application under Section 438 of Cr.P.C. not lies. 3.

Accordingly, the bail application filed under Section 438 of Cr.P.C. is dismissed.
