1. The only grievance that petitioner seems to be aggrieved of is the inaction on the part of the respondents in not complying with the circular dated 13.11.2009 in its letter and spirit.
2. According to the petitioner, he was appointed as Scientific Assistant vide order dated 31.10.2006 w.e.f. 17.10.2006. The appointment of the petitioner was on the post of Scientific Assistant. According to the petitioner, respondent no.1 vide their office memorandum dated 13.11.2009 had revised certain pay scales and also recommended for merger of certain pay scales into one pay scale and at the same time had also recommended for merger of the posts, the pay scale of which were merged together. In the process, the pay scale which the petitioner was drawing at the time of appointment i.e. the pay scale of Rs. 6500-10,500 was ordered and got merged to the pay scale of Rs. 7450-11,500. The petitioner on account of the said office memorandum started receiving higher pay scale of Rs. 7450-11,500. However, in spite of petitioner's pay band getting merged to Rs. 745011,500, the post on which the petitioner was working i.e. the post of Scientific Assistant was not merged to that of Scientific Officer and this is the precise grievance of the petitioner.

According to the petitioner, in spite of repeated representations for years altogether, the respondents have till date not taken any decision on the same and prays that the writ petition at this juncture may be disposed of directing the respondents to take an appropriate decision in the light of the said circular dated 13.11.2009 for the merger of the post of Scientific Assistant into that of Scientific Officer.
4. The limited relief that the petitioner sought for is not opposed by the
counsel for the respondents.

The writ petition therefore, at this juncture stands disposed of directing the respondents 2 & 3 to take an early decision on the representation which the petitioner has made for merger of the post of Scientific Assistant to that of Scientific Officer in the light of the circular dated 13.11.2009. The petitioner would also be at liberty to make a fresh representation to the respondents for ventilating his grievance.
6. Let a decision be taken in this regard at the earliest preferably within a period of four months from the date of receipt of copy of this order.
7. With the aforesaid observation, the writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge Khatai
