1. Notice send to complainant was served upon wife of complainant on 04.08.2021 as stated by learned State Counsel. He also submits that he has filed copy of service report of notice today.

2. Learned counsel for the appellant seeks permission of this Court to withdraw this appeal. However, he submits that looking to the nature of allegation, a direction be issued to learned Court below concerned to decide bail application for grant of regular bail on same day upon filing an application for regular bail after his surrender.

3. Learned State Counsel submits he is having no objection to the prayer made by learned counsel for the appellant.

4. Accordingly, bail application is dismissed as withdrawn. In the event, applicant files application for grant of regular bail after his surrender, learned Court below may decide bail application, if possible, on same day, in accordance with law.
