1. Heard.

2. This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.109/2012, registered at Police Station Kotwali, Raipur, District Raipur (CG) for the offence punishable under Sections 302 read with 34, 307 read with 34, 120-B, 201 of IPC, 1860 and Section 25 of the Arms Act, 1959.

3. The allegation against the present applicant is of involving himself in a case of contract killing, in which, deceased Dilip

Adwani was murdered.

4. The prayer of bail has been moved on the ground that the applicant is in jail since last about 6 years and one of the coaccused Shashibhushan Sao @ Pintu has been released on bail by Hon'ble the Supreme Court in SLP(Crl.) No.3252/2018.

5. The trial pending before the Sessions Court has been stayed at the instance of the present applicant in CRMP No.1513/2017, therefore, the applicant cannot take benefit of his own act of getting the trial Court proceedings stayed.

6. Considering the nature of evidence as also for the above-stated reasons, this Court is not inclined to release the applicant on bail.
