1. Challenge in this Petition is to the Order dated 17.09.2013 whereby the services of the Petitioner was transferred from Basna/Saraipali to Lohari district Koriya.

2. Learned Counsel for the Petitioner submits that an interim protection has been given by this Court vide Order dated 03.10.2013, on the basis of which the Petitioenr still continues to discharge his duties at Basna/Saraipali.

3. Learned Counsel for the State today makes submission that they do not wish to enforce the impugned order so far as the Petitioner is concerned. However, Counsel for the State prays for liberty that in case if need so arises they may pass a fresh order.

4. In the light of the statement made by the Counsel for the State nothing further remains to be adjudicated upon in the present Writ Petition.

5. With the aforesaid liberty the Writ Petition is dismissed as has become infructuous.
