Hon'ble Shri Justice P. Sam Koshy Order on Board 17/05/2018

1. The grievance of the petitioner, in the present writ petition, is the entries that have been made in the ACRs of the petitioner for the year, 2012 onwards up till date.

2. The counsel for the petitioner submits that against all those entries, the petitioner has already preferred a representation before the higher authorities. His further grievance is that the said ACRs were also not communicated to him timely, which was otherwise the requirement of law after the judgment of the Hon'ble Supreme Court in the case of "Devdutt vs. Union of India & others" reported in (2008) 8 SCC 725.

3. Taking into consideration the grievance of the petitioner, as also the fact that the representation, so far as this grievance is pending

consideration before the respondent No.1, this Court is of the opinion that ends of justice would meet if the writ petition is disposed of with a direction to the respondent No.1 to forthwith consider the representation and decide the same as expeditiously as possible and shall objectively consider the grievance of the petitioner taking note of all the contentions that he has raised in the representation.

4. The writ petition accordingly stands disposed off. Sd/- (P. Sam Koshy) Judge Ved
