This is a 3rd bail application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 393/2017 registered at Police Station Sirgitti, District Bilaspur, Chhattisgarh for the offence punishable under Sections 20(b)(ii)C) of the Narcotic Drugs and Psychotropic Substance Act, 1985. The first bail application was rejected on 04.07.2018 in MCRC No. 3427/2018 and the second bail application was rejected on 19.08.2018 in MCRC No. 5426/2019.

The quantity of contraband seized in the present case from the possession of the applicant and other coaccused persons is 128 kgs of Ganja. The present applicant is in jail since 10.12.2017 i.e. he has undergone a custody period of just about 2 years and 8 months period.

Considering the quantity of contraband seized and also looking into the period of custody undergone, this Court does not find any

change in circumstances or a strong case made out by the applicant for entertaining the 3rd bail application, the same stands accordingly rejected.

However, it is directed that as and when the Court starts hearing, the trial of the applicant should be tried to be concluded at the earliest. Sd/- (P. Sam Koshy) Judge Ved
