1) This appeal arises out of the judgment of conviction and order of sentence dated 30.04.2019, passed by the Second Additional Sessions Judge, Manendragarh, District- Koriya, (C.G.) in Sessions Trial No.113/2017, convicting the accused/appellant for the offence punishable under Section 307 of IPC and sentencing him to undergo rigorous imprisonment for 7 years with fine of Rs.5,000/-, in default of payment of fine to further undergo simple imprisonment for 6 months.

2) In this case as submitted by appellant's counsel, the sole appellant Sanjay @ Azad, died on 24.08.2020 and death certificate has been submitted before Additional Registrar (J) of this Court by Second Additional Sessions Judge, Manendragarh, Koriya (C.G.). The said certificate is in the record of this case. The fact of death of Sanjay @ Azad is also verified by the State

counsel. No application has been filed by the legal heirs or representatives of the deceased to prosecute this appeal. The entire fine amount imposed by the trial Court has already been deposited by the appellant.

3) In view of above, the present appeal stands abated due to death of the sole appellant and it is dismissed as such. Sd/- (Gautam Chourdiya) Judge Nadim
