Mr. Bhaskar Payashi, Panel Lawyer DB : Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Rajani Dubey Order On Board 27/07/2018 Heard.

This PIL Petition has been filed by the petitioners for direction to take proper disciplinary action against responsible officers, who have failed to make proper construction of overhead water tank.

2.

In the petition, allegations of misappropriation of Government money has been made. According to the petitioner, in the matter of construction of overhead water tank, the authority have chosen to install certain plastic/molded tanks. 3.

We find that earlier PIL was filed before this Court which was disposed off on 16.01.2017 without expressing any opinion on merits and with liberty to the petitioners to file a petition again if, after making a representation to the authority concerned, no action is taken by them.

4.

It appears that the petitioners made representation on 15.06.2017 and when did not hear regarding any decision taken on complaints, again this petition has been filed before this Court.

5.

From memo dated 24.07.2017 annexed along with petition Annexure P/5, it is revealed that the Government issued a direction to the Commissioner, Bastar Division to hold an enquiry and submit report.

6.

It appears that the enquiry still pending and decision has not been taken, till date. 7.

At this stage, we are inclined to dispose off the matter. The State, however, shall do well to ensure that enquiry is completed within a period of 3 months. Depending upon decision of the enquiry, proper decision may be taken. 8.

With the subject to the aforesaid observation, the petition is disposed off. Sd/- Sd/- (Manindra Mohan Shrivastava) (Rajani Dubey) Judge Judge Rekha
