Learned counsel for the petitioner submits that the petitioner is working as Class-I Officer at Dornapal Branch of Chhattisgarh Rajya Gramin Bank, which is a hard posting and he has been transferred from Dornapal to Chhote Dongar and according to the policy of the Bank, if the Officer had served in hard posting for two years then he is given liberty of choice to chose his next place of posting. It is stated in this case, the petitioner has worked for more than 6 years at Dornapal and he is ready and willing to forego his Branch Managership in which he has been transferred to Chhote Dongar. He further submits that the petitioner is 58 years old and he has to retire on the age of superannuation of 60 years and presently the petitioner's son & daughter both have suffered 7080% blindness, therefore, because of accumulated policy and

personal problem, he may be allowed to continue in the present place of posting or he may be given a choice of posting as he faced personal difficulties.

The respondent counsel submits that the representation has been made by the petitioner.

The petitioner, at this moment, submits that he may be given liberty to make another representation before the Bank and the Bank may be directed to decide the same according to the policy of posting & transfer and further taking into the personal difficulties of the petitioner.

Considering the submission made, the petition is disposed of with a direction that if the petitioner makes further representation within a period of three weeks from today then in such case the Bank may decide the place of posting of the petitioner according to its policy and taking into the personal difficulties of the children of the petitioner as also the period left for attaining the age of superannuation on the sympathetic ground. The Bank is further directed to decide such representation within a further period of six weeks. In the meanwhile, the petitioner shall continue in his present place of posting till the representation is decided. 5.

In view of the observation made, the impugned order dated 30.01.2017 (Annexure P-1) stands quashed.
