1. Counsel for the petitioner at the outset makes an oral request for impleading District Education Officer, District- Kabirdham as a necessary party as respondent No. 5.

2. Oral request is not opposed by the respondent counsel.

3. Accordingly, it stands allowed. Let necessary amendment be carried out during the course of the day itself.

4. The grievance of the petitioner in the instant case is that he had been temporarily posted at Government Middle School, Rajpur, Block Saharpur Lohara, District Kabirdham vide order dated 18/09/2018.

5. According to the petitioner he was sent only for the academic session 2018-19 which has since come to an end. Grievance of the petitioner is that on completion of session, the Block Education Officer on 23/04/2019 had recalled the services of the petitioner back to his substantive place of posting i.e at Middle School, Dhangaon, Block Sahaspur Lohara, District-Kabirdham which later on the Block Education Officer has recalled vide his order dated 26/04/2019 on the ground that since temporary posting of the petitioner was made by the District Education Officer, the Block Education Officer as such would not be competent to recall the services of the petitioner.

Given the nature of dispute/grievance that the petitioner has, this Court is of the opinion that no fruitful purpose would be served in keeping the writ petition pending rather ends of justice would meet if the writ petition disposed off with a direction to respondent No. 5 District Education Officer, Kabirdham for issuance of appropriate suitable order so far as the posting of the petitioner is concerned as the academic session 2018-19 has already come to an end. It shall be the responsibility of the petitioner to apprise the respondent No. 5 so far as the order passed by this Court is concerned.
