Contention of the petitioner is that since the appellate forum under the RERA Act has been constituted and has become functional, the petitioner intends to withdraw the present writ petition with liberty to challenge the impugned order before the Appellate Tribunal under RERA Act.

Prayer of the petitioner is not opposed by the respondent no.1 Hence, writ petition stands dismissed as withdrawn with the aforesaid liberty.
