Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/05/2016

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.3/2016, registered in Police Station : Sitapur, District Sarguja for offence under Section 304 &

201/34 of IPC and Section 135 of the Electricity Act.

2. It is alleged that deceased Timna Korwa died after coming into contact with live electric wire erected by the applicant and other accused persons to save agricultural field from wild animals.

3. Learned State Counsel would oppose the prayer for grant of bail.

4. Indisputably, co-accused Nohar and Santosh have been released on bail in M.Cr.C. No.1933/2016 and co-accused Bheleshankar has been released in M.Cr.C. No.2083/2016.

5. Considering the release of similarly placed co-accused persons, this Court is inclined to release the applicants on bail.

6. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court.
