1. Petitioners are seeking direction to the respondent authorities to count their earlier service period from the date of initial appointment for providing benefit of pay scale in the light of State Government's order dated 23.04.2016 which has been issued pursuant to the order passed by the Division Bench in Manoj Kumar Dadsena and others Vs. State of Chhattisgarh and others {WA No.413/2014} and other connected writ appeals on 09.12.2015.
2. Considering the fact that the respondents are yet to take decision in the matter, the writ petitions are disposed of with direction that in the event petitioners prefer fresh representation before the appointing authority/competent authority claiming benefit of circular dated 23.04.2016 within a period of one month from today, the authority shall verify the issue concerning application of the circular dated 23.04.2016 in respect of petitioners and pass necessary speaking order in this regard within further period of three months.
3. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
