Learned counsel appearing for the applicant would submit that despite service of notice, no response has been filed. Heard on I.A.No. 1 of 2017, application for condonation of delay in filing the instant MCC.

On due consideration and for the reasons stated in the application, I.A.No.1 of 2017 is allowed and delay in filing the instant MCC is condoned.

Also heard on MCC for restoration of MA(C) No. 141 of 2013 which was dismissed on 16-4-2015 for want of prosecution. On due consideration, the instant MCC is allowed and It is directed that MA(C) No. 141 of 2013 which was dismissed on 164-2015 for want of prosecution, be restored back to its original number.
