1. Smt. Sunita Jain, Govt. Advocate appearing for the respondents submits that the Superintending Engineer of Bilaspur division has also considered the applicant's case for grant of pension and considering the fact that the applicant stood convicted in a criminal case and that he was languishing in jail for a period from 2011 to 2018. The applicant has not been found fit for grant of the benefits as per the judgment of this Court in the case of Lakhanram Sahu and Ors vs State of Chhattisgarh & Ors.
-22. Given the said fact, that the respondents have taken a decision and found that the applicant is not entitled for grant of pensionary benefits, the Order passed by this Court stands duly complied-with.
3. However, in the event if the applicant is aggrieved of the subsequent decision of the respondents, he would be at liberty to challenge the same by way of fresh proceeding.
