1. By way of the instant revision, the applicant has challenged the judgment of conviction and sentence dated 20.07.2005 passed by Additional Sessions Judge, Baloda Bazar, in Criminal Appeal No. 85/2005, modifying the judgment of conviction and order of sentence dated 02-03-2005 passed by the Judicial Magistrate First Class, Baloda Bazar, in Criminal Case No. 1784/2002, convicting the accused/applicant under section 294 and 323 IPC and sentencing him to undergo rigorous imprisonment for 118 days and to pay fine of Rs. 100/- under Section 323 IPC, RI for 3 months to pay fine of Rs. 100/- under section 294 IPC with default stipulations.

2. Learned counsel for the applicants submits that the applicant has already undergone the entire jail sentence imposed on him and has been released from jail on 27.11.1996. 3.

State counsel too assisted the Court and submits that the applicant has completed the entire jail sentence imposed on him. 4.

In view of the fact that the applicant has already completed his jail sentence and has been released from jail in the year 1996, and keeping in mind the decision of the Hon'ble Supreme Court in case of D.S. Lahoriya @ Rajeev Sudan @ Vinay Kr. vs. State of Rajasthan, reported in 2007 AIR SCW 7327, the present revision is dismissed as having become infructuous.
