Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/05/2016 Heard.

1. This petition has been filed by the petitioner aggrieved by order dated 20.4.2016 by which petitioner's application for issuance of interim order

-2restraining issuance of permission to other bus operators has been rejected.

2. Learned counsel for the petitioner submits that the Tribunal has rejected application stating that there is no such order despite objection with regard to the time schedule and the route.

3. The matter arises out of order passed on interim application. The Tribunal was not inclined to grant an order restraining other operators on the time table and the route for which permit has been granted. The order does not suffer from any error of jurisdiction. Looking to the nature of relief, I am not inclined to interfere with the matter as the appeal is pending and it would be open for the Tribunal to decide all the issue on merits.

4. Learned counsel for the petitioner submits that the Tribunal may be directed to decide the appeal as early as possible.

5. It is directed that the appeal shall be decided as early as possible.
